Power of Attorney – ترتیب وکالتنامه

A Power of Attorney (POA) is a legal document issued by the Embassy and Permanent Mission of Afghanistan in Vienna to those who wish to appoint a representative to pursue their legal case on their behalf in Afghanistan. Power of Attorney can be issued based on the needs and requests of the applicants but most common are as follow:

POA for Property - وکالتنامه برای جایداد (Selling - فروش, Buying - خرید, Mortgage - گروی or etc - وغیره)

POA for Property - وکالتنامه برای جایداد (Selling - فروش, Buying - خرید, Mortgage - گروی or etc - وغیره)

In the event of someone cannot travel to Afghanistan and to facilitate in pursuing their legal matter related to property, the Afghanistan Legal Law allows someone to appoint an attorney to present him/her in all the legal and administrative processes within Afghanistan. If the property is inheritance related, then the applicants are required to prepare an Inheritance Letter (وراثت خط) before applying for Power of Attorney.

How to Apply – چگونگی درخواست- څرنګه غوښتنه وکړو

In-Person

  1. Come along with 2 Afghan male witnesses
  2. Prepare the required documents
  3. Book an appointment by sending an email to consulate@afghanistan-vienna.org
  4. Be present at your appointment with all the required documents as well as the witnesses

What documents you need to bring

  • Copy of passport or tazkera of the client
  • Copy of passport or tazkera of the representative in Afghanistan
  • Copy of passport or tazkera of the 2 witnesses
  • Proof of address in Austria of the client and 2 witnesses
  • Passport size photos of the client and 2 witnesses
  • Copy of the legal document such as a deed ‘Qawala’
  • Formal letter of request ‘Areeza’ clearly stating what the POA is for and what authority is given to the representative.
  • Duly filled and signed application form

Important Information

Once your appointment is confirmed you can send in the required documents to consulate@afghanistan-vienna.org for a draft POA to be prepared. This will help reduce your wait time at the consulate which normally can take up to 2 hours.

After the application is submitted, a draft POA will be handed over to the client for review. It is the applicant’s responsibility to check and confirm the content of the prepared POA before signing it. The fee paid is non-refundable. Should any changes need to be brought to the content of the document, a new POA must be applied for and a new fee applies.

POA for Marriage Certificate-وکالتنامه برای سند زوجیت

In the event, someone cannot travel to Afghanistan and to facilitate in registering and acquiring a marriage certificate, the Afghanistan Legal Law allows someone to appoint an attorney to present him/her in all the legal and administrative processes within Afghanistan.

How to Apply

Applications for Power of Attorney are considered strictly in person at the Consulate Section of the Embassy and must follow the below steps;

  • Book an appointment by sending an email to consulate@afghanistan-vienna.org
  • Prepare the required documents
  • The presence of the main client along with two male (Afghan) witnesses or one male and two female witnesses are strictly required.
  • Attend your appointment with all the required documents as well as the witnesses

What documents you need to bring

  • Formal letter of request ‘Areeza’clearly stating the Bride/Groom details, date of the marriage, place of the marriage, and what authority will be given to the attorney.
  • Duly filled and signed application form
  • Copy of the Passport or Tazkira (National ID) of the client(s)
  • Copy of the Passport or Tazkira (National ID) of the Attorney in Afghanistan
  • Copy of the Passport or Tazkira (National ID) of each witness
  • Proof of addresses in Austria of the client(s) and each witness
  • One Passport size photos of the client(s)and each witness
  • Copy of the Passport or Tazkira (National ID) of the Bride or Groom.

In the unfortunate event, if the client cannot travel to Afghanistan and require divorce, the Afghanistan Legal Law allows someone to appoint an attorney to present him in all the legal and administrative processes within Afghanistan for getting divorce.

How to Apply

POA for Business Relations-وکالتنامه برای موضوعات تجارتی

For all Business related matters whether registering a company, renewing licenses, opening bank accounts, and transactions, or any other reasons, the directors and their deputies who cannot travel to Afghanistan can appoint a representative to pursue all the processing and legal matters in Afghanistan authorities.

In the unfortunate event, if the client wants to terminate a power of attorney already prepared, the process is similar to applying for a power of attorney.

How to Apply

Applications for Power of Attorney are considered strictly in person at the Consulate Section of the Embassy and must follow below steps;

  • Book an appointment by sending an email to consulate@afghanistan-vienna.org and receive the booking confirmation
  • Prepare the required documents
  • Presence of the main client along with two male (Afghan) witnesses or one male and two female witnesses are strictly required.
  • Attend your appointment with all the required documents as well as the witnesses

  • Formal letter of request ‘Areeza’for termination of a previously issued POA.
  • Duly filled and signed application form
  • Copy of the Passport or Tazkira (National ID) of the client(s)
  • Copy of the Passport or Tazkira (National ID) of the Attorney Afghanistan
  • Copy of the Passport or Tazkira (National ID) of each witness
  • Proof of address in Austria of the client(s)and each witness
  • One Passport size photos of the client(s)and each witness

Inheritance Letter-حصر وراثت

Inheritance Letter-حصر وراثت

An inheritance Letter is a legal document proving the death and those who will inherit, used for the purpose of transferring or dividing the properties and belongings as well as the rights of the dead person. An inheritance Letter can be prepared in the presence of one of the Inheritors at the Consulate Section of the Embassy. All other inheritors who are living in Austria or any other countries are not necessarily required to be present.

How to Apply

Applications for Inheritance Letter are considered strictly in person at the Consulate Section of the Embassy and must follow the below steps;

  • Book an appointment by sending an email to consulate@afghanistan-vienna.org
  • Prepare the required documents
  • The presence of the inheritors/inheritress as well as Three confessors and Two male witnesses
  • Attend your appointment with all the required documents as well as the witnesses

What documents you need to bring

  • Formal letter of request ‘Areeza’
  • Duly filled and signed application form.
  • Copy of the Passport or Tazkira (National ID) of each inheritors/inheritress
  • Copy of the Passport or Tazkira (National ID) of each confessors
  • Copy of the Passport or Tazkira (National ID) of each witness
  • Proof of addresses in Austria of each confessors and witnesses
  • One Passport size photos of each confessor and witnesses
  • Death Certificate of the demised person.

Death Certificate-تصدیق سند فوتی

The Embassy and Permanent Mission of Afghanistan in Vienna will provide a no objection letter for the transportation of the deceased body of any Afghan Nationals as on when required basis.
